Terms and conditions


  • Prospective tenant” shall be understood to mean any individual who responds to a property/properties offered and mediated by Expata. “Tenant” shall be understood to mean any individual who as verbally and in writing accepted the terms and conditions for renting a specific property.
  • “Property” shall be understood to mean any residential property offered and mediated by Expata on behalf of its owner/landlord or offers for rent on behalf of colleague rental agencies.
  • The data you have supplied has been entered correctly and to the best of your ability.
  • The data you have supplied will be dealt with on a strictly confidential basis.
  • The confirmation of this registration does not constitute the right of assignment.
  • The data you have provided may and shall be checked by Expata.
  • The rental of the property offered will be mediated by Expata on behalf of the landlord.
  • Viewing of a property by the prospective tenant is always at no obligation and at no cost.
  • If, after viewing, a tenant candidate indicates that he/she wants to be made eligible to rent the property, a declaration of intent to rent will be signed.
  • Signing of the declaration of intent to rent obligates the prospective tenant to rent the property, unless landlord decides not to offer the prospective tenant a rental agreement, regardless of the reason. Expata does not assume any liability for this decision by the owner/landlord.
  • It is not possible to take an option on a house.
  • If it happens that no permission was given for letting of a property the letting will be cancelled without any rights to be derived from any of our announcements or down payments. In such a case, Expata will not be held responsible for the consequences in any way.
  • All written and verbal offers made by Expata concerning accommodation or commercial property are without obligations. No rights can be derived from these offers.
  • All statements, commitments and offered agreements by Expata and its staff shall at all times be subject to the approval of the landlord and/or owner of the property. Expata cannot, in part due to its dependence on third-parties for the obtainment of information, provide any guarantee regarding the accuracy, completeness and up-to-dateness of the information provided by Expata.
  • Expata is not liable for how the landlord, following signing of a rental agreement, does or does not fulfil his/her obligations. The prospective tenant shall always consult directly with the landlord. The prospective tenant indemnifies Expata of any and all claims for damages by the owner / landlord and/or third-parties in any form whatsoever.
  • Expata is not liable for consequences arising from inconsistencies, incomplete information or errors in the rental agreement that are the result of erroneous information provided to Expata by the landlord.
  • Any disputes between the prospective tenant and Expata shall be subject to Dutch law.
  • By renting a house and signing the accompanying tenancy agreement you commit yourself to pay rent, deposit and commission/mediation costs ( € 295,- excl.21% tax ) by means of a bank transfer or in particularly exceptional cases in cash.
  • The rent level advised by Expata does not have to comply with the rent commission’s point system. Neither the lessor nor the lessee can and will hold Expata responsible as the lessor (landlord) is the one responsible for the level of the rent.
  • From the moment you have fulfilled your financial obligations towards Expata, you will have to give account only to the lessor (landlord) or property manager. Expata can then no longer be hold responsible.
  • Expat works on a No cure, no pay base. By giving us the assignment to rent a property for you, you will be charged a fee same amount as the rent excl. 21% tax.
